Mrs Walton – Motorbike Accident Injury Claim from £25,000 to £100,000
Mrs Walton transferred her motorbike accident claim to Hutcheon Solicitors after 4 years. Her Solicitors who dealt with the motorbike accident were instructed via her husband’s motorbike insurance company. As with most motorbike accident claim victims, the easy decision was made as the insurance company was dealing the cost of the damage to the bike and the legal insurance cover would be provided to their own panel solicitors.
This is quite a usual thing to do by most motorbike accident claim victims as they are often too pre-occupied by their injuries than to select a motorbike accident solicitor.
Well after 4 years of dealing with her insurance company’s appointed panel solicitors Mrs Walton became somewhat unhappy about the progress of her claim. Court proceedings were issued just before the deadline of 3 years and her case was handled by numerous different solicitors and legal clerks. By the time she got to know one Solicitor, that accident solicitor left the Firm and she had to once again repeat her instructions again and again.
Mrs Walton then contact me. I explained that I operate on a No Win, No Fee basis and that it is a fundamental right for motorbike accident claim victim to have a FREE CHOICE OF ACCIDENT SOLICITORS. She signed a single page authority to send her bike accident file to me. When I reviewed the file sent to me from her previous bike accident solicitors I quickly arranged to bolster the medical evidence to support her motorbike serious injuries.
Injuries Sustained
She was travelling as a passenger (pillion) on the back of her husband’s motorbike when after a dangerous manoeuvre by her husband an accident occurred resulting in her becoming departed from the bike and her leg and back colliding with a wall. She sustained serious fractures to her lower leg and a back injury resulting in numerous operations and visits to hospital, GP and physiotherapy.
Action Upon Transfer of a Motorbike Claim
Immediately upon transfer of a new motorbike claim I review the entire file and provide a plan of action. In Mrs Walton’s case it meant urgent action to update her orthopaedic evidence. I also undertook further psychological evidence due to flash backs, nightmares and nervousness about her travelling generally. There was a need to support her continuous pain and investigate the unsightly scarring tissue. Additional medical evidence was obtained by a pain consultant and plastic surgeon. She obtained numerous help from her family such as cooking, cleaning, diy, ironing, travelling and a very detailed statement from her and her family was obtained to support a multi-thousand pound family care claim. Often the care claim is often overlooked by inexperienced motorbike accident claim victims.
At the time of the transfer there was an offer from the husband’s insurance company (it was her husband that she had to sue) of just £25,000. When we settled the case we obtained £100,000.
